Fifth Circuit: Alien Enemies Act Not a License to Deport Venezuelan Gang Members

On September 3, 2025, the U.S. Court of Appeals for the Fifth Circuit issued an order and an opinion, prohibiting U.S. President Donald Trump from continuing to rely on the Alien Enemies Act of 1798 (“the Act”) to accelerate the deportation of Venezuelan immigrants who are alleged to belong to the criminal organization Tren de Aragua.
