Abstract: 
The constitutionality of pretrail restraining orders which freeze a defendant's assets pending trial has become the subject of heated debate.  On the one hand, government attorneys have argued that the Continuing Criminal Enterprise Statute (CCE), the Racketeer Influenced and Corrupt Organizations Act (RICO), and the Comprehensive Forfeiture Act of 1984, mandate seizure of assets which are the fruit of illegal activity.
