EU Court of Justice Applies Inhuman and Degrading Treatment Rules to the European Arrest Warrant’s Scheme

On April 5, 2016, the Court of Justice of the European Union – Grand Chamber (the Court) delivered its judgment in the joined cases of Pál Aranyosi (C‑404/15) and Robert Căldăraru (C‑659/15 PPU). The ruling concerns some aspects arising out of the execution a European Arrest Warrant (EAW), specifically inhuman and degrading treatment in the context of Article 3 of the European Convention on Human Rights (ECHR).
