Abstract:
On April 11, 1994, the Canadian Government, through its Department of Justice, applied for leave to intervene in the case of the suit filed by Kenneth Walker against the U.S. Government and other defendants. On January 31, 1994, the Canadian Court of Appeals for Ontario held inter alia that the defendant Bank of New York Inc. and two of its employees were each "an organ of the [United States of America]" within the meaning of section 2 of the State immunity Act.
