Abstract:
In late January 2017, the British Columbia Court of Appeal (BCCA) for Vancouver, British Columbia, Canada reversed a lower court decision and consigned jurisdiction to the BC courts to hear a claim of human rights violations brought by a group of seven Guatemalan plaintiffs. The plaintiffs are claiming damages for negligence and battery against Canadian mining company Tahoe Resources Inc.
